In short, Florida's new child custody and parenting plan law gets rid of the concept of "custodial parent" and "noncustodial parent." Instead of a structure in which one parent has primary custody and the other parent has visitation rights, under Florida's new law both parents will continue to have parenting responsibilities after the divorce — unless shared responsibility is detrimental to the child.
Regardless of the changes to Florida's child custody and visitation law, child support is still calculated based on the amount of time the child spends with each parent and the parents' relative income levels.
Under the new law, all divorcing parents will be required to complete a parenting plan agreement that addresses issues such as: the time each child will spend with each parent; how the parents will communicate with each other and with the child; and who will have responsibility for issues like health care coverage and school-related matters.
